100.5 Categorias de operações de UAS (a) As operações de UAS devem ser realizadas em uma das seguintes categorias e condições: (1) Aberta: (i) peso em voo menor ou igual a 25kg; (ii) VLOS ou EVLOS; (iii) até 120 metros (400 pés) AGL; (iv) em áreas distantes de terceiros, sob total responsabilidade do seu operador; e (v) deve haver uma avaliação de risco operacional, em formato aceitável, contemplando cada cenário operacional, exceto como previsto no parágrafo (a)(1)(v)(B) desta seção. (A) A avaliação de risco operacional deve estar atualizada dentro dos últimos 12 (doze) meses calendáricos prévios à operação. (B) Caso a operação ocorra a mais de 150 metros horizontais de pessoas não envolvidas e não anuentes ou caso haja uma barreira mecânica suficientemente forte para isolar e proteger as pessoas não envolvidas e não anuentes, esta avaliação de risco operacional será considerada facultativa. (2) Específica: (i) caso um dos requisitos do parágrafo 100.5 (a)(1) não seja atendido; e (ii) deve atender aos critérios estabelecidos na Subparte B deste Regulamento. (3) Certificada: (i) caso envolva o transporte de artigos perigosos que possam resultar em alto risco para terceiros em caso de acidentes. Neste caso, a operação deve atender a critérios aceitos pela ANAC; ou (ii) a ANAC, com base na avaliação de risco operacional prevista na Subparte B deste Regulamento, considerar que o risco da operação não pode ser adequadamente mitigado sem a certificação.
