② 지방항공청장은 제1항에 따른 신청서를 제출받은 날부터 30일(새로운 기술에 관한 검토 등 특별한 사정이 있는 경우에는 90일) 이내에 법 제129조제5항에 따른 무인비행장치 특별비행을 위한 안전기준에 적합한지 여부를 검사한 후 적합하다고 인정하는 경우에는 별지 제123호의3서식의 무인비행장치 특별비행승인서를 발급하여야 한다. 이 경우 지방항공청장은 항공안전의 확보 또는 인구밀집도, 사생활 침해 및 소음 발생 여부 등 주변 환경을 고려하여 필요하다고 인정되는 경우 비행일시, 장소, 방법 등을 정하여 승인할 수 있다.
