제1항에도 불구하고 초경량비행장치 중 무인비행장치 조종자로서 야간에 비행 등을 위하여 국토교통부령으로 정하는 바에 따라 국토교통부장관의 승인을 받은 자는 그 승인 범위 내에서 비행할 수 있다. 이 경우 국토교통부장관은 국토교통부장관이 고시하는 무인비행장치 특별비행을 위한 안전기준에 적합한지 여부를 검사하여야 한다.
