２　法第百三十二条の四十六第一項第三号に該当する者については、次に掲げる基準に従い、技能証明を行わず、又は六月以内において期間を定めて技能証明を保留することができる。 一　法第百三十二条の四十六第一項第三号に該当することを理由として同項ただし書の規定により技能証明を保留された者が重ねて同号に該当した場合には、同条第五項の規定による命令に違反したことについてやむを得ない理由がある場合を除き、技能証明を行わないものとする。 二　法第百三十二条の四十六第一項第三号に該当する場合（前号に該当する場合を除く。）には、技能証明を保留するものとする。
