Daylight Flight Requirement

You must fly only between sunrise and sunset unless a licensed pilot is flying a certified drone (for flights without keeping people out of the area, this needs a first-class licence and a Type 1 certified drone). Otherwise, night flights need prior approval from the Minister, unless an exemption applies.

Requirement as structured

Except where a person holding a competency certificate flies an unmanned aircraft holding an airworthiness certificate (and, for flights without entry-control measures, only where a first-class pilot flies a Type 1 certified aircraft), a person flying an unmanned aircraft must fly it between sunrise and sunset. Flying outside these hours requires prior approval from the Minister under Article 132-86(3), unless an exemption under Article 132-86(5) applies.

２　無人航空機を飛行させる者は、技能証明を受けた者が機体認証を受けた無人航空機を飛行させる場合（立入管理措置を講ずることなく無人航空機を飛行させるときは、一等無人航空機操縦士の技能証明を受けた者が第一種機体認証を受けた無人航空機を飛行させる場合に限る。）を除き、次に掲げる方法により、これを飛行させなければならない。 一日出から日没までの間において飛行させること。
