(2) Für die Erteilung einer Betriebsgenehmigung in der Betriebskategorie „speziell“ nach Artikel 5 Absatz 1 in Verbindung mit Artikel 12 Absatz 1 bis 4 und Teil B des Anhangs der Durchführungsverordnung (EU) 2019/947 ist die Luftfahrtbehörde des Landes zuständig, es sei denn, es geht um die Erteilung einer Betriebsgenehmigung nach Artikel 5 Absatz 4 Buchstabe b der Durchführungsverordnung (EU) 2019/947. Die örtliche Zuständigkeit richtet sich bei natürlichen Personen nach dem Hauptwohnsitz des Antragstellers, bei juristischen Personen nach dem Sitz des Antragstellers. (3) Absatz 2 gilt entsprechend für die Aktualisierung der nach Absatz 2 Satz 1 erteilten Betriebsgenehmigung im Falle eines Betriebs in einem anderen Mitgliedstaat der Europäischen Union nach Artikel 13 Absatz 2 Satz 2 der Durchführungsverordnung (EU) 2019/947.
