If you are a member of an air sports association (or of a model flying club within one) that holds an Article 16 authorisation, you may fly model aircraft under the association's approved procedures instead of the general EU drone requirements; certain UAS.OPEN.060 pilot duties still apply.

Requirement as structured

Members of air sports associations, or members of model aircraft clubs organised in air sports associations, may operate model aircraft deviating from the requirements of Implementing Regulation (EU) 2019/947, provided the operation complies with the relevant internal association procedures on the basis of which an authorisation under Article 16 of that Regulation in conjunction with § 21g has been granted. It must be ensured that remote pilots comply with UAS.OPEN.060 point 2(a) to (d) in conjunction with point 4 of Part A of the Annex to that Regulation.

(1) Der Betrieb von Flugmodellen durch Mitglieder von Luftsportverbänden oder durch Mitglieder von in Luftsportverbänden organisierten Modellflugvereinen ist abweichend von den in der Durchführungsverordnung (EU) 2019/947 festgelegten Anforderungen an den Betrieb von unbemannten Fluggeräten zulässig, sofern er unter Einhaltung einschlägiger verbandsinterner Verfahren erfolgt, auf deren Grundlage eine Genehmigung nach Artikel 16 der Durchführungsverordnung (EU) 2019/947 in Verbindung mit § 21g erteilt worden ist. Dabei ist sicherzustellen, dass Fernpiloten die Bestimmungen von Punkt UAS.OPEN.060 Nummer 2 Buchstabe a bis d in Verbindung mit Nummer 4 in Teil A des Anhangs der Durchführungsverordnung (EU) 2019/947 einhalten.
