この場合の「上空」とは、「第三者」の直上だけでなく、飛行させる無人航空機の落下距離（飛行範囲の外周から製造者等が保証した落下距離）を踏まえ、当該無人航空機が落下する可能性のある領域に第三者が存在する場合は、当該無人航空機は当該第三者の上空にあるものとみなす。
