EASA accepts that the minimum horizontal distance from a person passing the area is estimated as no less than the distance the UA would cover in 2 seconds at maximum speed, as a means of complying with UAS.OPEN.040(1).

A minimum horizontal distance from the person that is passing the area could be estimated as follows: [...] (3) no less than the distance that the UA would cover in 2 seconds at the maximum speed (this assumes a reaction time of 2 seconds).
