You need a public-benefit, research or commercial purpose, a competency certificate, and for commercial work you must show the job really needs a drone — unless the aerodrome or military air station ordered the job itself.

Requirement as structured

Trafikstyrelsen may permit a derogation from the IMC aerodrome and military air station distance and altitude rules in § 9, stk. 1-3 where the drone operation serves a public-benefit, research or commercial purpose; where the purpose is commercial, the drone operation must be necessary and the task must be substantially frustrated, made more expensive or otherwise impaired if carried out other than by drone; and the remote pilot must hold a competency certificate. The necessity condition does not apply where the publicly approved aerodrome or the military air station itself commissioned the task.

Stk. 4. Trafikstyrelsen kan give tilladelse til at stk. 1-3 fraviges, hvis 1) droneoperationen har et samfundsnyttigt, forskningsmæssigt eller kommercielt formål, 2) hvis formålet er kommercielt, at droneoperationen er nødvendig, og at formålet med opgaven i væsentlighed forspildes, fordyres eller på anden måde forringes, hvis den skal gennemføres på en anden måde end med en drone, og 3) fjernpiloten har et kompetencecertifikat. Stk. 5. Stk. 4, nr. 2, anvendes ikke, hvis den offentlig godkendte flyveplads eller militære flyvestation har bestilt opgaven.
