Benutzt jemand das Luftfahrzeug ohne Wissen und Willen des Halters, so ist er an Stelle des Halters zum Ersatz des Schadens verpflichtet. Daneben bleibt der Halter zum Ersatz des Schadens verpflichtet, wenn die Benutzung des Luftfahrzeugs durch sein Verschulden ermöglicht worden ist.
