You must be able to see your drone if needed, and you and your visual observer must have a clear, pre-agreed plan on how to communicate and react if something goes wrong to keep the drone safe and in sight.

Guidelines for the ability of the FPV flyer to see the aircraft throughout the entire flight. 6. Guidelines for communications, such as requiring that the FPV flyer and VOs have preplanned communications and procedures to ensure the UA remains under control and within VLOS during any event when the safe operation of the aircraft is in question.
