Action Required Upon Detecting Manned Aircraft

If you are flying near a non-controlled airport or helicopter pad and realize a manned aircraft is nearby, you must immediately fly away from its path, land safely, and do not take off if you are still on the ground.

Requirement as structured

If a pilot becomes aware of a manned aircraft in the no-fly zone of a non-controlled aerodrome or HLS, they must immediately maneuver the RPA away from the manned aircraft, land as soon as safely possible, or refrain from launching if on the ground.

Original regulatory text

If the person who is flying an RPA or model aircraft within relevant airspace becomes aware that a relevant event is occurring, or is about to occur, the person must: (a) if the RPA or model aircraft is airborne: (i) act immediately to ensure that the RPA or model aircraft is safely manoeuvred away from the path of the manned aircraft; and (ii) land the RPA or model aircraft as soon as safely possible; or (b) if the RPA or model aircraft is on the ground, on water, or on any object or structure on the ground or water — not launch the unmanned aircraft.
