Requirement as structured

Two statutory derogations from the prohibition exist. The Finnish Food Authority (Ruokavirasto; named Elintarviketurvallisuusvirasto in the Act) may decide on aerial application of a plant protection product to combat a plant pest, together with its decision on pest control measures under the Plant Health Act (702/2003), where the pest poses an immediate threat to plant health and cannot reasonably be controlled effectively by other means. The Ministry of Agriculture and Forestry may, on the proposal of a regional unit of the Finnish Forest Centre, decide on aerial application against extensive forest damage to trees growing in a forest, together with its decision on measures under the Act on the Prevention of Forest Damage (1087/2013), where the damage cannot reasonably be prevented effectively by other means.
